More Time Offered for CWA
Guidance Comments
Dec. 6, 2007 -- The Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers have extended the time period in which comments can be offered regarding the Clean Water Act (CWA) guidance, which reflects two U.S. Supreme Court decisions (on the cases Rapanos v. United States and Carabell v. United States) that redefined waterways under the law. The original deadline was Dec. 5; it has been extended by 45 days – to Jan. 21, 2008.

Critics say the court’s ruling seems to deny CWA protection to intermittent streams as well as seasonal bodies of water that form the headwaters for many major U.S. rivers. Supporters of the revisions argue that the court has appropriately narrowed the scope of the clean water law to cover only major bodies of water.

According to the EPA, the guidance would help restore and protect of 3 million acres of wetlands by 2009.
